This License Agreement sets out the terms on which DashboardPack (“we”, “us”) licenses its premium themes and templates (the “Item”) to you (the “purchaser”). It applies to all three license tiers — Personal, Developer and Lifetime. The tier you bought is shown on your receipt and order confirmation. For a plain-English comparison and FAQ, see our License Comparison.
1. The license tiers
- Personal License. A non-exclusive, worldwide license to use the Item in a single End Product, for one project of your own or for one client, worked on by a single developer. Includes 6 months of premium support and updates.
- Developer License. A non-exclusive, worldwide license to use the Item in an unlimited number of End Products, for yourself or for multiple clients, with an unlimited number of developers on your team. Includes 12 months of premium support and updates. Permits internal tools and free SaaS (where end users are not charged), but not a paid SaaS.
- Lifetime License. Everything in the Developer License, plus the right to build a paid SaaS or commercial product where end users are charged for access, and to include our UI elements, components or layouts as part of your own product. Includes premium support and updates for the lifetime of the product.
2. What an “End Product” is
-
An End Product is something you create using the Item that requires an application of skill and effort:
-
For an Item that is a template, the End Product is a customised implementation of the Item.
For example: the Item is a dashboard template and the End Product is the finished application, customised with your own content and functionality. - For other types of Item, the End Product is something that incorporates the Item together with other things, so that it is larger in scope and different in nature than the Item.
-
For an Item that is a template, the End Product is a customised implementation of the Item.
- How many End Products you may create depends on your tier: the Personal License covers a single End Product; the Developer and Lifetime Licenses cover an unlimited number of End Products.
- You can modify, adapt and combine the Item with other works to create a derivative work as your End Product. The resulting works remain subject to the terms of this license.
3. Building for clients
- You may create an End Product for a client. Under the Personal License this is limited to a single client project; the Developer and Lifetime Licenses cover unlimited client projects.
- You may deliver the finished End Product, including its source code, to your client. The license to the underlying Item stays with you as the purchaser and is not transferred to the client. Your client may not extract the Item from the End Product, use it separately, or reuse it in other projects.
4. Selling and charging end users
- You may sell the End Product itself — for example, a finished website or application delivered to a client — under any license tier.
- Building a paid SaaS, application or service where end users are charged for access (by subscription, one-time fee or otherwise) requires the Lifetime License. The Personal and Developer Licenses do not permit charging end users for access, even where the Item itself is not being redistributed.
5. Restrictions that apply to every tier
-
You can’t re-distribute the Item as stock, in a tool or template, or with source files — either on its own or bundled with other items — and you can’t make it available as-is or with only superficial modifications.
For example: you can’t license an Item and then make it available on your website for your users to download. -
You can’t use the Item in an application that lets an end user customise a digital or physical product to their own needs — an “on demand”, “made to order” or “build it yourself” application, page builder or generator.
For example: you can’t build a website or page builder from the Item. - You must not permit an end user of the End Product to extract the Item and use it separately from the End Product.
- You can’t sell, distribute, lease or license our UI elements, components or layouts to third parties as-is. (The Lifetime License permits including them as part of your own product, but never as standalone assets.)
- You can’t use the Item in a logo, trademark or service mark.
- You can only use the Item for lawful purposes. If an Item contains an image of a person, even where the Item is model-released, you can’t use it to create a fake identity, imply personal endorsement, or in a way that is defamatory, obscene, demeaning, or in connection with sensitive subjects.
6. Third-party components
-
For some Items, a component will be sourced from elsewhere and different license terms may apply to that component (for example, someone else’s license, or an open-source or Creative Commons license). Where this is the case, the component is identified in the Item’s documentation or its downloaded files, and the other license applies to that component instead of this one. This license applies to the rest of the Item.
For example: a theme might contain images licensed under a Creative Commons CC BY license. The CC BY license applies to those images; this license applies to the rest of the theme.
7. Support and updates
- Premium support and updates are included for 6 months (Personal), 12 months (Developer) or the lifetime of the product (Lifetime), from the date of purchase. After your support period ends you may keep using the Item on your licensed End Products, but you will not receive further updates or support unless you renew or upgrade your license.
8. General
- This license applies in conjunction with the DashboardPack Terms & Conditions. If there is an inconsistency between this license and the Terms & Conditions, this license applies to the extent necessary to resolve the inconsistency.
- This license can be terminated if you breach it. If that happens, you must stop making copies of, and distributing, the End Product until you remove the Item from it.
- DashboardPack retains ownership of the Item but grants you this license on these terms. This license is between DashboardPack and you.
